Terms and Conditions: Introduction
These pages, the content and infrastructure of these pages, as well as the online booking service (including the payment processing service) provided by us on these pages and through the website, are owned and operated by Travalmenu.ge and are provided solely for your personal, non-commercial (B2C) use with subject to the conditions set out below. Our interaction with the Travel Supplier is governed by separate terms and conditions governing the business relationship between us and each Travel Supplier (B2B). Travel Provider and Travalmenu.ge enter into a commercial relationship when it provides access to its product and / or service on / through Travalmenu.ge (both for other companies (B2B) and end users (B2C)). In addition to the terms and conditions and important information posted on the website, Travel Providers are entitled to apply and / or require acceptance and performance of their own additional terms and conditions relating to Travel (including liability provisions).
“Travalmenu.ge”, “we”, “us / us” or “our / our / our / our” means Travalmenu.ge a limited liability company registered in accordance with the laws of Georgia at Mtskheta, Tsodoreti. “Service” means an online purchase, order, payment (payment processing) or reservation offered by Travalmenu.ge with respect to the products and services of the Travel Provider on the Platform.
“Booking” means an order, purchase, payment or reservation of a Trip.
1. Description of our Service
Through the Platform, we (Travalmenu.ge and its affiliate partners (distribution partners)) provide an online platform through which Travel Providers - as part of their professional activities (B2B or B2C) - can advertise, market, implement and / or offer their products and services for ordering, purchasing, reserving or renting, and guests of the Platform can find such products or services, compare, order, purchase or pay for them. Using the Service (i.e., making a Booking through the Service), you enter into a direct (legally binding) contractual relationship with the Travel Provider, from which you reserve or purchase a product or service. From the time you make your Reservation, we act exclusively as an intermediary between you and the Travel Provider, transmitting the relevant data of your Booking to the appropriate Travel Provider (s) and sending you an electronic confirmation on behalf of the Travel Provider. Travalmenu.ge does not (re) sell, rent or sell any Trips, products or services.
When providing our Service, the posted information is based on information provided to us by Travel Providers. Travel Suppliers who post and promote their Travels on the Platform have access to our systems and extranets and are fully responsible for updating information about prices, rates, fees, availability of numbers, rules, terms of other data reflected on our Platform. Despite the fact that we are doing everything possible to ensure the quality of our Service, we do not check the accuracy and can not guarantee the accuracy or completeness of all information, and are not responsible for any errors (including obvious errors and typos), failures ( incurred due to (temporary and / or partial) breakdowns, repairs, improvements or maintenance of our Platform or for other reasons), inaccurate, inaccurate or false information or failure to provide information. Each Travel Provider under any conditions is responsible for the accuracy, completeness and correctness of (descriptive) information (including tariffs, fees, prices, rules, conditions and availability of rooms) displayed on our Platform. Our Platform is not and should not be considered as a recommendation or evidence of quality, level of services or rating, classification (star) of any proposed Travel Provider (or its amenities, products, services, facilities or vehicles (basic or additional)), if directly not specified otherwise.
Our Service is provided only for individual, non-commercial use. Based on this, you do not have the right to resell, create external hyperlinks, use, copy, track (for example, using spider and scraping), display, download or play any part of the content or information, software, bookings, tickets, products or services available on our Platform for any commercial or competitive activity or purpose.
2. Prices, crossed tariffs and the service “We return the difference in price”
The prices offered by the Trip Providers on our Platform are very competitive. All Travel Rates include VAT / sales tax and other taxes (which are subject to change) and fees, unless otherwise specified on our Platform or in an electronic booking confirmation / ticket. The ticket price is per person or group, the validity period is indicated on the ticket (if applicable). If the Travel Provider charges a penalty for cancellation or no-show, relevant fees and taxes (including tourist / city tax) may also be added to it.
Sometimes, our Platform provides lower rates for a certain period of stay, product or service, however, such fares offered by the Travel Provider may have special restrictions and conditions, for example, Bookings for such rates cannot be canceled, or refunds for such Reservations are not possible. Please read the relevant terms of booking, providing a product or service before making a reservation.
The crossed out tariff for rooms is calculated on the basis of the third largest price offered by the Trip Provider for your Trip with identical booking or purchase conditions 15 days before the date of arrival or use of the product and 15 days after it. If between today and the date of arrival or use of the product is less than 15 days, we add the appropriate number of days after the date of arrival or use of the product so that the total is 30 days.

Obvious errors (including typos) are not legally binding.
All special promotions and offers are flagged accordingly. If there is no corresponding mark, you cannot claim any rights in case of an obvious error.

4. Free for customers, only Travel Suppliers pay!
Unless otherwise specified, our service is free for customers, since unlike many other companies, we do not charge you for our Service and do not add additional fees (for making a reservation) to the tariff. You pay the Travel Provider the cost indicated in the Booking (plus all applicable applicable taxes and fees if they are not included in the price).
Travel Providers pay a fee (a small percentage of the product price (eg, room)) Travalmenu.ge after the user has used the product or service provided by the Trip Provider (for example, after the guest has stayed at the accommodation (and paid for accommodation)). Travel Providers can improve their location by increasing the amount of commission (the “Become more visible” tool). The use of the “Become More Visible” tool (by paying a higher percentage of commission in return for increasing the location) is at the discretion of each Travel Provider and can be used as needed for certain products. The position determination algorithm takes into account the increase in commission and on its basis determines the Default Sort. Privileged partners pay a higher commission for higher locations.
Only those Travel Providers who have established a commercial relationship with Travalmenu.ge (by entering into a contract) will be given access to the Platform (to promote their B2B product and / or B2C. Travalmenu.ge is not an open platform (like Amazon or eBay), where the end user can offer his own product (i.e. Travalmenu.ge is not a C2C platform); Travalmenu.ge does not allow non-professional parties to offer their product on or through Travalmenu.ge.
5. Credit card or bank transfer
If applicable and possible, some Travel Suppliers may offer the option to pay for the Booking (in whole or in part, in accordance with the rules of the Travel Provider) to the Travel Provider in the process of making the Booking through a secure online payment (depending on the support of this function by your bank). For some products and services, Travalmenu.ge charges (through a third-party payment system) payment for the product or service on behalf of the Travel Provider (Travalmenu.ge does not act under any circumstances as a person selling the product or service). Secure payment is made through the third-party payment system from your credit / debit card or from your bank account to the Travel Provider. Each payment that we process on behalf of the Travel Provider, and which is transferred to it, is a payment (part) of the cost of the product or service you have reserved and is taken into account in the final settlement (bevrijdende betaling). Payment made is not refundable.
Please note that for certain (non-refundable) fares or special offers, Travel Suppliers may require payment in full by bank transfer (if applicable) or by credit card, so your credit card may be pre-authorized or funds may be charged. (sometimes without the possibility of a refund) when making a reservation. Please check the details (bookings) of the service or product before proceeding with the Booking procedure. Travalmenu.ge is not responsible for any (authorized or possible unauthorized or erroneous) debiting by the Travel Provider and does not refund any amounts legally written off or previously blocked by the Travel Provider (including prepayment, no-show penalty or cancellation) your map.
In the event that your credit card was used by third parties illegally or improperly, the majority of the banks and companies that issued the credit cards assume the coverage and payment of all damages caused by such illegal use of a credit card (sometimes minus 50 euros or the local equivalent). currency). Such damages are made only for bookings using a credit card made through the secure server of Travalmenu.ge, and illegal use of your credit card, which occurred through no fault of your own while using the secure server.
6. Prepayment, cancellation, no-shows and important information
By making a reservation with the Travel Provider, you accept and agree to the cancellation policy, the rules in case of a no-show, and all additional terms and conditions (provision of services) of the Travel Provider that may apply to your Trip (including important information from the Travel Provider, which is published on our Platform and the Travel Provider’s internal regulations), including those regarding the services and products provided by the Travel Provider. Applicable terms and conditions (submission / purchase / use) may be obtained from the respective Travel Provider. General rules regarding cancellation and no-show of each Travel Provider are available on our Platform on the Travel Provider page, during the booking process and in the booking confirmation / ticket confirmation (if applicable). Please note that certain rates, fees and special offers are not subject to cancellation, refund or change. The Travel Provider may charge an applicable city or tourist tax, even in the event of a no-show or cancellation of the cancellation fee. We recommend that you carefully review the details (reservations) of a product or service and special rules before making a reservation. Please note that reservations requiring deposit or prepayment (full or partial) may be canceled (without prior notice or warning) if the corresponding (remaining to pay) amount cannot be charged in full on the relevant date or the date of payment according to the booking and the rules of the Travel Provider. Cancellation and prepayment policies may vary depending on the segment, product or service of the Trip. Please carefully read the important information (located under the Travel Types or at the bottom of the Travel Provider page on the Platform) and indicated in your booking confirmation (this information, in particular, may relate to age restrictions, security deposit, special cancellation conditions and other conditions for group bookings conditions for extra beds, pay breakfast and pets). You bear all the risks associated with late payment, incorrect debit or credit card data, or insufficient funds on your card. You are not entitled to claim a refund of any (non-refundable) prepaid amount unless the Travel Provider agrees or permits otherwise in accordance with its rules of (pre-) payment and cancellation.
If you are late on the day of check-in, arrive late or only the next day, (timely / promptly) inform the Travel Provider about this. Thus, the Travel Provider will know when to expect you, this may help to avoid canceling the Trip (Booking) and a no-show penalty. If necessary, our support service can contact the Supplier of Trips for you. Travalmenu.ge is not responsible for the consequences of your late arrival, as well as the cancellation of a reservation or a no-show penalty charged by the Travel Provider.
7. (Further) correspondence and communication
By completing your Reservation, you agree to receive (i) an e-mail, which we can send to you just before the day of arrival, with information about the relevant destination, certain data and special offers (including with special offers from third parties, for which you actively receive agreed) relating to your Booking and referral, (ii) an email upon arrival with a request to evaluate the Travel Provider (impressions of working with him) and the Service, and (iii) an email, which we can send to you immediately after your stay in the hotel, with a proposal to fill out our hotel review form. Please read the Privacy and Cookies section for information on how we can contact you.
Travalmenu.ge is not responsible for exchanging messages on the part of or with the Travel Provider that is made on or through its platform. You cannot claim any rights based on any request or message sent to the Travel Provider or received from it, or confirmation (in any form) that the request or message is received. Booking.com cannot guarantee that the request or the message will be (properly and timely) received / read, fulfilled or accepted by the Travel Provider.
To complete and guarantee your reservation, you must specify the correct email address. We are not responsible for (and are not required to verify) any invalid or incorrectly written email address, incorrectly specified (mobile) phone number or credit card number.
Any claims or complaints regarding Travalmenu.ge or the Service must be filed as soon as possible, but in any case within 30 days after the scheduled day of use of the product or service (for example, departure date). Any claims or complaints sent after the 30-day period may be rejected, and the party making the claim is deprived of the right to any compensation (for damages or costs).
Due to the fact that prices and availability are constantly changing and adjusting, we strongly recommend that you take a screenshot at the time of booking as evidence (if necessary).
8. Sorting, Priority Accommodation Program, stars and guest reviews
By default, the Trip Providers on our Platform are sorted by “Travalmenu.ge Recommendations” (any similar wording can be used). This is "Sort by default". The default sorting is based on a complex, constantly changing algorithm that takes into account many criteria in order to match the search query with the results of the issue in the most optimal way. The order of displaying the accommodation objects is different for different users and depends on their search queries and many other criteria, for example, the popularity of the accommodation object among website users (for example, rating by reviews), interaction history with customer support (including the number and type of guests complaints), some booking information (for example, the number of bookings, cancellations, conversion rate, overbooking, availability of rooms, etc.), as well as (past) user search actions. The algorithm for generating a Sort by default also includes data on the timely payment of the commission by the Supplier of Rides and the interest rate of the commission. For your convenience, we also offer many other ways to sort out Travel Providers. So, the user can sort the search results by the lowest price, rating by reviews, type of placement, etc. Thus, the user completely controls the display of the accommodation objects in the search results.
In some cities and regions, Travalmenu.ge implements a privileged partner program that allows certain Trip Providers that meet the program conditions to be displayed above the rest of the Travel Providers in the results for the respective city / region when sorted according to the “Recommended” criterion (sorted by default). Priority Travel Providers are marked with a thumb up and pay a higher commission for higher accommodation. Priority can only be Travel Providers that meet certain specified criteria on an ongoing basis.
The number of stars in the accommodation feature displayed on Travalmenu.ge is not set by Travalmenu.ge. The number of stars is set directly by the accommodation or (objectively) assigned by an independent third-party organization for the classification of hotels. Special offers are displayed in accordance with the number of stars (ascending or descending) provided by the Travalmenu.ge accommodation objects. Depending on the (local) regulatory requirements, the number of stars is either appointed by an (independent) third party, for example, a (official) hotel classification organization, or based on the opinions of the housing providers themselves, regardless of objective criteria. Travalmenu.ge does not impose formal obligations on the classification of accommodation facilities by the number of stars and does not check it for compliance with reality. In general, this classification demonstrates how housing complies with the requirements of the law (if applicable) or, if the classification is not regulated by law, industry or (adopted) industry standards in terms of price, amenities and services available (these requirements and standards may vary for different countries and organizations).
Only those users who have stayed at the Accommodation Facility will be asked to leave a review about their stay at the relevant property on Travalmenu.ge and give a rating to certain aspects of their stay or a request will be sent asking them to rate during their stay. A completed review (including an estimate sent during your stay) can be (a) posted on the relevant page of the Trip Provider on our Platform for the sole purpose of communicating (to future customers) your opinion on the level of services and quality of the Trip Provider, and (b) (fully or partially) used by Travalmenu.ge at its own discretion (for example, for marketing purposes, advertising purposes or to improve the service provided) on its Platform or on social media platforms, in newsletters, special x promotions, applications, or when using any other channels owned or controlled by Travalmenu.ge or its business partners. We strive to publish and maintain new and relevant reviews, so you can leave feedback only for a limited period of time (28 days) after using the Trip. Each review is available only for a limited time period (24 months) after publication. Sort feedback by default is determined by the publication date together with some other criteria (such as language, comments). A feedback from a user who [constantly] leaves full and detailed reviews (the “Researcher”) may have the highest position. You can sort reviews by various criteria, as well as apply filters (for example, by group, date, language, rating). Travalmenu.ge provides the Trip Provider with an opportunity to respond to a review. We reserve the right to change, reject or delete reviews at our discretion if they violate our rules for writing reviews. Travalmenu.ge does not pay any compensation or other rewards to the user for posting a review. Forms for guest reviews are sent only for the purpose of the survey and do not contain any further (commercial) offers, invitations or promotions. Travalmenu.ge reserves the right to follow the publication of reviews and delete them if they contain profanity, as well as mention of names or stolen items.
Travalmenu.ge does not publish reviews that include:
offensive language, obscene content, aggressive language, discrimination, threat or insult;
mentions of full names or statements addressed personally to employees;
incitement to illegal activities (for example, related to drugs or prostitution);
websites, email addresses, phone numbers, credit card details;
comments on the topic of politics.
Travalmenu.ge and Travel Supplier have the right to terminate cooperation for any reason (including breach of contract or in case of bankruptcy (or filing an application for it)), while respecting the relevant notice period agreed by the parties.
In accordance with the restrictions set forth in these terms and conditions and in accordance with the law, we are only liable for direct damages actually incurred, paid or caused due to improper fulfillment of our obligations when providing services within the total amount of your order, as stated in the electronic Reservation Confirmation Letter (for one incident or a series of related events).

Travalmenu.ge is not responsible for the transfer, collection, withholding or payment of the relevant taxes from the cost of (Travel) or the fee to the authorized tax authorities. Travalmenu.ge does not act as a person selling products or services offered on the Platform.
By uploading photos / images to our system (for example, in addition to recalling), you acknowledge, warrant and agree that you are the copyright holder of these photos / images and agree to use Travalmenu.ge downloaded photos / images on your (mobile) site and in the application for mobile devices, in promotional materials and publications (posted online and offline), as well as in any other way at the discretion of Travalmenu.ge. You grant Travalmenu.ge a non-exclusive, worldwide valid, irrevocable, unconditional and perpetual right and permission to use, reproduce, display, copy, distribute, license, transfer and post photos / images in any way at the discretion of Travalmenu.ge. When uploading these photos / images, the person uploading the photo (s) assumes full legal and moral responsibility for all legal claims from third parties (including but not limited to Travel Providers) in connection with the publication and use of Travalmenu. ge of these photos / images. 10. Intellectual Property Rights

11. Applicable law, jurisdiction and dispute resolution
These terms and conditions and the provision of our services are governed and subject to interpretation in accordance with the laws of Georgia. Notwithstanding the aforementioned choice of law, an individual who uses any of our services for a purpose that may be interpreted as going beyond his occupation or profession (hereinafter “consumer”) may rely on the mandatory provisions of the law of the country in which he lives on a permanent basis (that is, the provisions that, in accordance with the rules of choice of legal norms of this country, should apply regardless of this clause on the applicable law (hereinafter - "Mandatory Provisions")). Any disputes arising from these General Terms and Conditions and our services are subject to the exclusive jurisdiction of the competent courts of the city of Tbilisi, Georgia. Notwithstanding the aforementioned jurisdiction clause, the consumer may also file claims for the enforcement of the relevant Mandatory Provisions in the courts of the country in which he resides on a permanent basis. The proceedings against the consumer can be conducted only in the courts of the country in which he lives on a permanent basis. For consumers (in the EEA): we advise first of all to address any complaints to our support service. If this way your problem is not resolved, upload your complaint through the European Commission's online dispute resolution platform.
The original English version of these terms and conditions could be translated into other languages. The translated version is an unofficial and official translation, and you cannot claim any rights based on the translated version of these terms and conditions. In case of disputes about the content or the interpretation of these terms and conditions, as well as in case of discrepancies or inconsistencies between the English version and any other language version of these rules and conditions, the English language version must be used, prevail and be uncontested in accordance with the law. If any provision of these terms and conditions is or becomes invalid, becomes invalid or becomes invalid, the remaining provisions of these terms and conditions will be applied in full.
